First published in 1917 and 1918, with a second edition in 1946, this is the first English translation of Santi Romano's classic work, L'ordinamento giuridico. The main focus of The Legal Order is the notion of institution, which Romano considers to be both the core and distinguishing feature of law. After criticising accounts of the nature of law centred on notions of rule, coercion or authority, he offers a compelling conception, not merely of law as an institution, but of the (...) institution as 'the first, original and essential manifestation of law'. Romano advances a definition of a legal institution as any group who share rules within a bounded context: for example, a family, a firm, a factory, a prison, an association, a church, an illegal organisation, a state, the community of states, and so on. Therefore, this understanding of legal institutionalism at the same time provides a ground-breaking theory of legal pluralism whereby 'there are as many legal orders as institutions'. El objetivo de este estudio ha sido valorar la dinámica del cambio que sufre el léxico disponible en inglés de hablantes nativos de español en estudiantes de 1º de ESO y 1º de Bachillerato para poder comprobar si existe una evolución positiva entre los dos cursos escolares. Para ello, se han utilizado los indicadores de disponibilidad léxica, compatibilidad y Porcentaje de Disponibilidad Retenida (PDR) en un conjunto de 184 informantes. Con los resultados obtenidos, se ha podido confirmar, para los ocho (...) centro de interés analizados, que son muy pocos los vocablos que concentran la mayor cantidad de disponibilidad léxica en cada área asociativa. Además, con la metodología seguida también se ha podido valorar el cambio en la adquisición del léxico entre las dos etapas educativas. (shrink)

Drosophila limbs and the vertebrate central nervous system are subdivided into compartments. Cells in adjacent compartments do not mix. Cell interactions mediated by Notch-family receptors have been implicated in the specification of these compartment boundaries. La estética analítica hizo suyo, entre otros, el problema de la definición del arte y halló en el concepto dantiano de artworld una alternativa de solución eficiente. Motivador de subsecuentes propuestas, el costado más contextualista del programa de Arthur Danto debe aún enfrentar el reclamo de una supuesta falta de especificidad. Este escrito busca poner en diálogo dicho aporte teórico con los desarrollos hechos por Nelson Goodman en torno al arte a fin de aportar elementos de efectiva visibilidad frente a (...) tal reclamo. Al hacerlo, se prevé analizar la diferencia introducida por este último a propósito de la ejecución y la implementación como instancias configuradoras de lo artístico de espesor y relevancia para su lectura funcionalista. La articulación de un bloque explicativo afin a ambos planteos supone, así, una alternativa novedosa para el área teórica en que se inserta al tiempo que otorga una ventaja considerable frente al marco contextualista del tratamiento del problema. Analytic aesthetic addressed the problem of the definition of art and found an al ternative efficient solution in the Dantian concept of artworld. Nevertheless, the contextualist side of the Danto's program must face the claim of a certain lack of specificity. This paper seeks to link that with the developments made by Goodman around art in order to provide effective visible elements to such claim. In doing so, it is expected to analyze the difference between execution and implementation as central instances of artmaking according to his functionalist reading. The relation between both accounts represents, thus, an innovation over the theoretical area in which is inserted as much as a considerable advantage over the contextualist treatment of the problem. Não teria o conhecido desenvolvimento sem que no processo cultual interviesse a disciplina escultórica que logo em 1920 faria cristalizar, através do escopro de um santeiro, a imagem de Nossa Senhora do Rosário de Fátima. O estudo do tipo, do arquétipo e dos subtipos da Virgem de Fátima, primeiramente produzidos em (...) oficinais trabalhos de santeiros e, em fase posterior, interpretados por artistas, permite entender os contornos do nascimento de uma realidade imagética, isto é, de uma iconografia ex nihilo e o seu, necessariamente, tardio desenvolvimento estético. Este artículo se propone describir la dinámica demográfica desde 1997 en Argentina y una provincia por cada región para considerar el impacto de la crisis de 2001-2002 y las etapas posteriores hasta 2016. Los marcos conceptuales elegidos son la transición demográfica y la vulnerabilidad sociodemográfica, a partir de los cuales se identifican perfiles demográficos que representan obstáculos para la mejora de las condiciones de vida (Torrado, 1995; Rodríguez Vignoli, 2001; CEPAL, 2002a y 2002b). A partir de proyecciones de la población (...) y registros de estadísticas vitales (nacimientos y defunciones), se calculan indicadores de mortalidad (esperanza de vida al nacimiento, mortalidad infantil y materna) y fecundidad (tasa global y tasa de fecundidad adolescente), para 1997 y cada año calendario del período 2001-2016. La principal contribución a los estudios de población es el cálculo y análisis de indicadores demográficos anuales, ya que el Instituto Nacional de Estadísticas y Censos sólo publica indicadores de fecundidad y mortalidad provinciales cada diez años, con cada censo de población.Los resultados muestran una evolución positiva de los indicadores demográficos en el país, desde 1997 y luego de la crisis socioeconómica de 2001-2002, aunque con persistencia de las brechas estructurales entre regiones. La esperanza de vida ha crecido en todas las jurisdicciones hasta 2015, cuando comienza a descender en todo el país. La mortalidad infantil disminuye rápidamente en todo el país, particularmente en las provincias más rezagadas. La mortalidad materna se ha reducido claramente en las poblaciones más rezagadas y se muestra inestable en las más avanzadas.La fecundidad general desciende suavemente; la fecundidad adolescente sólo disminuye en las provincias con mayores tasas.El avance en la transición demográfica en Argentina coexiste con situaciones de vulnerabilidad social en todo el país, especialmente en el noreste. Se advierte la sensibilidad de la mortalidad a las crisis económicas experimentadas desde 2008. (shrink)

This paper analyzes correspondence between Reichenbach and Einstein from the spring of 1926, concerning what it means to ‘geometrize’ a physical field. The content of a typewritten note that Reichenbach sent to Einstein on that occasion is reconstructed, showing that it was an early version of §49 of the untranslated Appendix to his Philosophie der Raum-Zeit-Lehre, on which Reichenbach was working at the time. This paper claims that the toy-geometrization of the electromagnetic field that Reichenbach presented in his note should (...) not be regarded as merely a virtuoso mathematical exercise, but as an additional argument supporting the core philosophical message of his 1928 monograph. This paper concludes by suggesting that Reichenbach’s infamous ‘relativization of geometry’ was only a stepping stone on the way to his main concern—the question of the ‘geometrization of gravitation’. Reductionists in biology claim that all biological events can be explained in terms of genes and macromolecules alone, while antireductionists argue that some biological events must be explained at a higher level. The literature, however, does not distinguish between different kinds of molecular explanation. The goal of this article is to identify and analyze three such kinds. The analysis of molecular explanations herein carries an important philosophical implication; in shunning crude reductionism and extreme versions of holism, we can combine the (...) insights of thoughtful reductionists with sophisticated antireductionism. When this is done, the question of explanatory reductionism becomes less substantial than often supposed. (shrink)

This article presents and discusses one of the most prominent inferential strategies currently employed in cognitive neuropsychology, namely, reverse inference. Simply put, this is the practice of inferring, in the context of experimental tasks, the engagement of cognitive processes from locations or patterns of neural activation. This technique is notoriously controversial because, critics argue, it presupposes the problematic assumption that neural areas are functionally selective. We proceed as follows. We begin by introducing the basic structure of traditional “location-based” reverse inference (...) and discuss the influential lack of selectivity objection. Next, we rehearse various ways of responding to this challenge and provide some reasons for cautious optimism. The second part of the essay presents a more recent development: “pattern-decoding reverse inference”. This inferential strategy, we maintain, provides an even more convincing response to the lack of selectivity charge. Due to this and other methodological advantages, it is now a prominent component in the toolbox of cognitive neuropsychology. Finally, we conclude by drawing some implications for philosophy of science and philosophy of mind. (shrink)

We investigate the major mathematical theories of space from a modal standpoint: topology, affine geometry, metric geometry, and vector algebra. This allows us to see new fine-structure in spatial patterns which suggests analogies across these mathematical theories in terms of modal, temporal, and conditional logics. Throughout the modal walk through space, expressive power is analyzed in terms of language design, bisimulations, and correspondence phenomena. The result is both unification across the areas visited, and the uncovering of interesting new questions.

The aim of my paper is to compare three alternative formal reconstructions of van Inwagen’s famous argument for incompatibilism. In the first part of my paper, I examine van Inwagen’s own reconstruction within a propositional modal logic. I point out that, due to the expressive limitations of his propositional modal logic, van Inwagen is unable to argue directly (that is, within his formal framework) for incompatibilism. In the second part of my paper, I suggest to reconstruct van Inwagen’s argument within (...) a first-order predicate logic. I show, however, that even though this reconstruction is not susceptible to the same objection, this reconstruction can be shown to be inconsistent (given van Inwagen’s own assumptions). At the end of my paper, I suggest to reconstruct van Inwagen’s argument within a quantified counterfactual logic with propositional quantifiers. I show that within this formal framework van Inwagen would not only be able to argue directly for incompatibilism, he would also be able to argue for crucial assumptions of his argument. (shrink)

Climate change governance is extremely challenging because of both the intrinsic difficulty of the issues at stake and the plurality of values and worldviews. For these reasons, the ethical concerns that characterise climate change should also be meaningfully addressed through a specific version of procedural justice. Accordingly, in this article we adopt an impure notion of procedural justice. On this theoretical basis, we define relevant fairness criteria and contextualise them for climate governance systems. Then, we empirically justify fairness criteria against (...) a critical and divisive element for the future governance of the Green Climate Fund, i.e., the no-objection procedure. The concept of indiscernibility in a structure is analysed with the aim of emphasizing that in asserting that two objects are indiscernible, it is useful to consider these objects as members of (the domain of) a structure. A case for this usefulness is presented by examining the consequences of this view to the philosophical discussion on identity and indiscernibility in quantum theory.

Scott Sehon recently argued that the standard notion of determinism employed in the Consequence Argument makes it so that, if our world turns out to be deterministic, then an interventionist God is logically impossible. He further argues that because of this, we should revise our notion of determinism. In this paper I show that Sehon’s argument for the claim that the truth of determinism, in this sense, would make an interventionist God logically impossible ultimately fails. Computational models of meaning trained on naturally occurring text successfully model human performance on tasks involving simple similarity measures, but they characterize meaning in terms of undifferentiated bags of words or topical dimensions. This has led some to question their psychological plausibility (Murphy, 2002;Schunn, 1999). We present here a fully automatic method for extracting a structured and comprehensive set of concept descriptions directly from an English part‐of‐speech‐tagged corpus. Concepts are characterized by weighted properties, enriched with concept–property types that approximate classical (...) relations such as hypernymy and function. Our model outperforms comparable algorithms in cognitive tasks pertaining not only to concept‐internal structures (discovering properties of concepts, grouping properties by property type) but also to inter‐concept relations (clustering into superordinates), suggesting the empirical validity of the property‐based approach. This contribution explores in detail the presence and the context of two quotations of the philosopher and theologian Abū Ḥāmid al-Ġazālī (Algazel for the Latin world) in Albert the Great’s late Summa theologiae sive de mirabili scientia Dei. The two quotations, which concern the notion of the soul as “abridged letter” or “copy” [nusḫa muḫtaṣara, chartula brevis] on which all pieces of knowledge are potentially transcribed, occur in two significant textual points of Albert’s Summa. Two different aspects of al-Ġazālī’s simile (...) are addressed in the article: the consideration of the soul as a book, which has extremely wide biblical and literary echoes, and the consideration of the soul as a place, also with regard to the already Aristotelian, and then Albertinian notion of locus intelligibilium. The feature the two passages by Albert share is the acknowledgment of Algazel as a source of primary importance, capable of corroborating with his authority both a Christian theological doctrine and the littera itself of Aristotle’s De anima, in a culturally momentous philosophical-theological, and Islamic-Christian, cooperation. Thanks to a focused analysis on further contexts of reception of the same Ġazālīan image, which bear witness to its peculiar memorability and its differentiated usages, the article argues in conclusion in favour of a more attentive and in-depth study of philosophical similes such as the one here discussed. The present volume examines the question of the significance of narratives for the ethical judgement in medicine and care and illustrates what theological reflection can contribute to the current discussion about the ethics of medicine and care. The focus of the volume is on the theological discussion on the ethical issues of medicine and care which is enriched by contributions from literary studies, (...) philosophy, nursing science and the ethics of medicine and care. This article provides a contribution to the concept of a peace ethics which understands human peacemaking as a churchly practice accepting and joining in God's reconciling works. From a pacifist stance, the author argues that ecclesial ethics allows a forceful reframing of the just war tradition as it is developed in the largely unknown Reformed confessions of the l61 h century. A theological exploration of the peace church's pathos drives the author towards a rediscovery of the church's central worshiping practices, (...) such as eucharist, as distinctively peacemaking practices. Following John Calvin's and Karl Barth's ethical account, the mode of peacemaking is defined as a hastening that waits. (shrink)

In this paper, I try to show that Kripke’s proposed solution to the problem of negative existentials fails. I try to show that Kripke’s proposal fails because it entails that anybody who has good reasons to believe that there are no propositions has also good reasons to believe that he or she does not exist. However, there were philosophers who had good reasons to believe that there are no propositions even though they didn’t have good reasons to believe that they (...) do not exist. I conclude that Kripke’s proposed solution to the problem of negative existentials fails. (shrink)

Este trabajo presenta al ideal nietzcheano del Übermensch interpretado desde la perspectiva "débil" de Gianni Vattimo como alternativa en el sentido de la Verwindung heideggeriana al esquema de la subjetividad moderna. Este ideal se presenta no solo como una de las principales formas de vida en las condiciones tardo-moderna de existencia, sino que es parte de un más ambicioso proyecto que intenta redefinir el antiguo concepto de emancipación en la tradición hegelo-marxista en términos de reducción de la violencia. In the present article, I review some evidence that shows how body odor disgust sensitivity plays a central role in the so-called behavioral immune system, a set of processes aimed at detecting, emotionally reacting, and behaviorally avoiding pathogen threats. I also report empirical evidence on how the BODS relates to social attitudes such as authoritarianism, xenophobia, and condemnation of “impure” moral violations. This research is interpreted from an Evolutionary psychology framework.

Following a trend in bioethical/applied ethics approaches, one of the frustrating features of studies on technological human enhancement is their dichotomous tendency. Often, benefits and risks of technological human enhancement are stated in theoretically and empirically vague, polarized, unweighted ways. This has blocked the debate in the problematic ‘pros vs. cons’ stage, leading to the adoption of extremist positions. In this paper, we will address one side of the problem: the focus on risks and the imprecise approach to them. What (...) motivates our approach is the identification of the weaknesses of the anti-enhancement criticism, which stem from its use of the concept of risk, as well as the heuristic of fear and the precautionary principle. Thus, ‘taking a step back’ to move forward in the debate, our purpose is to establish some theoretical foundations concerning the concept of risk, recognizing, at the same time, its complexity and importance for the debate. Besides the concept of risk, we emphasize the concept of existential risk, and we make some considerations about epistemic challenges.
